I have had a HVAC Company (Oliver Heating and Cooling) poorly installed the following items in my home. They came out, spiked the job, and have not been paid a dime. When I complained about the work, (Kinked/compressed flex duct, repair a crawlspace vent which they broke, a condensation drain which drains into my crawlspace, fiberglass and duct tape laying INSIDE of a register, dampers which flop and do not operate, balance the system.....), and requested they return to properly complete the job, a crew was sent out twice, but never fixed the problems. They stopped responding to my calls, yet continue to send invoices for the 'completed job'. (Their words, not mine) They never obtained a permit for the job, and so I contacted my Township's Code Enforcement. My Township Codes enforcement has just left, and the 2 inspectors informed me of the following. - The length of flex duct used on most of the runs (2 runs have in excess of 20') was in excess of the National Mechanical Standards. - Multiple runs have the flex duct kinked so badly that little or no airflow is getting thru the runs. - Flex duct used exposed in the closets should be 'hard' duct so as to prevent puncturing. - 2 rooms require more than the one duct installed in them.
They told me to do the following; ** Obtain the "Installation Instructions" for the equipment that was installed..., which was the following; ->Carrier 58CVA090-1-16 Furn (4304A3887) ->Carrier CK3BXA036017 Coil (4004X19741) ->ATCO Rubber Prod, 7" Dia., R-4.2 Flex Duct, Because the items and materials were used outside of the 'manufacturer’s specifications'.
Question, WHERE would I find the installation instructions and specs for the above items.
ALSO, I will NOT allow Oliver back into my home, and have obtained proposals to have the job completed properly. I also only intend to pay Oliver for THEIR cost for the above furnace and air handler, and nothing else. I also am typing a letter to the Better Business Bureau.

Of note, the installing comapny has been notified by the Codes Enforcement officer of his inspection. The VP pretty much wanted to perform oral on me and let them 'make this right'. One thing P1zzed me off though, he kept saying he didnt feel "I" made every effort to, and allow THEM to fix the problem!!" I told him, that this wasnt a frelling basebal game, and his company came back TWICE after they 'completed', and still failed to address the deficiencies. WHY should I allow them back. He said he felt I should have tried to get in touch with the manager........... I told him MY obligation ended when his company stopped returning my calls. He then said they have never had any issues like this with over thousands of installs a year, hundreds of men on the street...... I asked him if they needed that many men just because they had to go back on a regular basis to RE-do the original work? So I asked him about the neighbor who on my very street had his furnace, air-handler installed backward by his company. HIS response was, "Well we went back and made that right didnt we?" My head about exploded and I shot back, "So, your company has a habit of screwin up, then fixing their mistakes, is THAT what you're saying...?" JUST VENTING HERE. They offered 5-10% off the job, (original cost of $8,000.00+), free maintenace for 5 years, blah blah blah. I told him at this juncture, I am only interested in paying THEIR cost for the furnace, Airhandler and thermostat, and having another company come and properly finish the job. As it stands now, they asked me to have another company come in, spec out the job properly, and have THEM come in and do it to the new specs, then have the other company come in and inspect the job. I told them I would let think about it. WTF

I dont know where u are from but i believe here in Texas if u dont not have a mechanical license and install a unit the owner is not legally obligated to pay for it!

I am in Pennsylvania. And I had brought that up to the codes enforcer. He said as long as the installer was a journeyman/apprentice(sp) and 'supervised' by a licensed HVAC tech, that it was fine.
A new twist, my wife got a call yesterday from the VP of the company (which is a big title for a small company) and I told her to have them call me. The VP said he would conference call me today sometime.
Quite frankly, I am going to tell them they can 'eff' off. After they said the job was 'complete', we had them come back twice to fix things which were not done properly, and then they stopped returning our calls. This isnt a friggin baseball game, and I am not giving them a third strike...........
The call should be interesting, because the VP saounded as if he didnt believe the rep who stopped returning ours calss would do such a thing.

from the sounds of things, you must have signed a legal contract for the offending firm to install the equipment in your home. legally, you are obliged to pay that same firm, BUT, you do have recourse inthat they did take out a permit AND the inspectors have found and noted the installation to be defective in workmanship. It is the contractors, not the homeowner, to provide requested documentation for the inspector. Also, I am suprised that the contractor did not provide any drawings to the township when they applied for your permit. One of the nice things about permits, is that if the contractor's work is not up to code standards, the township and/or the home owner can apply to the courts to have the contractors business licences and even their trade licences revoked! The consumer protection act does work to protect those who are willing to stand up and be heard!
No matter how idiot proof you make something better idiots will always try and screw around with it!

Thanks Mike, here's a bit more info, and I appologize if I was unclear.
1 - No, no contract or proposal was signed by either my wife or I. Like I said, I feel we told them "yea, looks good, when can you start?" And they were here the next day starting, without a signed contract, deposit, or proposal. Hence my stating the way the job was started as "spiking".
2- The codes guy was nice, but I am not impressed with him, or the 'HVAC' specialist they brought out to look at the job. (HE was just shaking his head, pulled me aside, and said take pictures of whats up there, no matter what recourse you take), but was not specific..... I get the feeling that both men are 'reluctant' to make a 'stand' where this company is concerned. Sort of like a "well yeas, there are some probelms, but maybe you could give them another chance.....""They are usualy a reputable company""Ive never had any complaints about them before...."
3- No permit was, or has been applied for to date, hence the reason codes came in, in the 1st place, and is citing them simply for failure to get a permit. The codes guy said he would only cite them for deficiencies(sp) if "I" obtained the manufactureres specs for the furnace, air handler, and flex duct.........WTF.
As far as the consumer protection act, I intend to send Oliver a certified letter, stating I will only pay them for their cost of the equip, minus my costs to repair damage they caused to my house, and then have another company come in and properly do the job. If they try any legal BS, or to put a mechanics lein on the property, then I will contact my State Attorney General's office...........
But right now, I am in need of the Specs for the above Equip..... (Any othee insight would be most appreciated as well) ;)

But back to my original request.
WHERE CAN I FIND THE MANUFACTURER SPECS FOR THE ABOVE LISTED EQUIP?
I have tried the internet.
If anyone has them out there electronicaly, please email them to me annonymously.

Am working on that, but they are less than eager to talk to, and give that info to anyone NOT an installer/contractor........................................ And getting the mechanical codes R: the usage of the flex duct is even harder. Im still waiting on ATCO to respond/return my calls...............
